These Terms apply to all users, including visitors, registered users, and customers booking travel services through BURTour.

BURTour LLC operates as an online travel agency offering a platform to browse, select, and book pre-designed travel tours worldwide. Our services include:
A catalog of tours organized by continent, country, and travel type (e.g., beach vacations, adventure tours, cultural trips, or extreme adventures).
Filters to help users find tours based on preferences.
Travel-related advice, including articles on best travel seasons, visa requirements, and travel tips.
Access to customer reviews and feedback to assist with decision-making.
Booking and payment processing for selected tours.
We act as an intermediary between you and third-party travel providers (e.g., airlines, hotels, tour operators). The services provided by these third parties are subject to their own terms and conditions, which you must also comply with.
3. Eligibility

5.1 Booking Process
When you book a tour through our website, you are entering into an agreement with BURTour and the relevant third-party travel providers. You agree to:

Review and confirm all booking details before finalizing your reservation.
Comply with the terms and conditions of third-party providers involved in your tour.
5.2 Payment
Payments for bookings are processed through secure third-party payment processors. You agree to:
Pay all applicable fees, taxes, and charges associated with your booking.
Ensure that your payment method is valid and has sufficient funds.
Acknowledge that prices are subject to change until the booking is confirmed.
5.3 Confirmation
Upon successful payment, you will receive a booking confirmation via email. This confirmation serves as proof of your reservation but does not guarantee the availability of third-party services (e.g., flights or accommodations), which are subject to the providers’ availability.
6. Refund Policy
We understand that travel plans may change. Our refund policy is designed to provide clarity and fairness while accounting for the constraints of third-party providers. Please review the following refund terms carefully:
6.1 Cancellation by You
Standard Cancellation: You may cancel your booking by contacting us at [email protected] or +1 513-499-7423. Refunds, if applicable, depend on the cancellation policies of the third-party travel providers (e.g., airlines, hotels, tour operators) and the timing of your cancellation:
Cancellations made more than 60 days before departure: You may be eligible for a full refund, minus a non-refundable administrative fee of $50 per person.
Cancellations made 30–60 days before departure: You may receive a partial refund (typically 50% of the booking cost), subject to the third-party provider’s terms.
Cancellations made less than 30 days before departure: No refunds are typically available, as most providers impose strict non-refundable policies.
Non-Refundable Bookings: Certain tours or promotional offers may be explicitly marked as non-refundable at the time of booking. In such cases, no refunds will be issued, regardless of cancellation timing.
Documentation: To process a cancellation, you must provide your booking reference number and submit a written request via email or our contact form.
6.2 Cancellation by BURTour or Third-Party Providers
If BURTour or a third-party provider cancels a tour due to unforeseen circumstances (e.g., safety concerns, insufficient bookings, or force majeure events such as natural disasters or political instability), we will:
Offer you an alternative tour of comparable value, subject to availability.
If no suitable alternative is available, provide a full refund of the booking amount paid to BURTour, excluding any non-refunded fees charged by third-party providers.
Refunds will be processed within 14 business days of the cancellation confirmation and returned to the original payment method.
6.3 Changes to Bookings
Changes by You: Requests to modify booking details (e.g., travel dates, destinations, or traveler names) are subject to availability and the policies of third-party providers. An administrative fee of $25 per change may apply, in addition to any fees charged by providers.
Changes by BURTour or Providers: If we or our providers need to modify your booking (e.g., itinerary changes or schedule adjustments), we will notify you as soon as possible and offer alternatives or refunds as applicable.
6.4 No-Show or Early Departure
No refunds will be issued for missed departures, unused portions of a tour, or early departures, unless explicitly permitted by the third-party provider’s policy.
6.5 Travel Insurance
We strongly recommend purchasing travel insurance to protect against unforeseen cancellations, medical emergencies, or other travel disruptions. BURTour is not responsible for losses not covered by our refund policy.
7. User Responsibilities
You agree to:
Provide accurate and complete information during booking or account creation.
Comply with all applicable laws, regulations, and travel requirements (e.g., visas, vaccinations, or travel permits).
Behave respectfully and lawfully during your travels, adhering to the policies of third-party providers.
Review and follow safety guidelines, travel advisories, and instructions provided by BURTour or tour operators.
You are solely responsible for obtaining necessary travel documents (e.g., passports, visas) and ensuring compliance with entry requirements for your chosen destinations.
8. Intellectual Property
All content on our website, including text, images, logos, and design elements, is owned by or licensed to BURTour LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or modify our content without prior written permission, except for personal, non-commercial use.
9. User-Generated Content
By submitting reviews, feedback, or other content (e.g., photos or comments) to our website, you:
Grant BURTour a non-exclusive, royalty-free, worldwide license to use, display, and reproduce your content for promotional or operational purposes.
Confirm that your content does not infringe on third-party rights or contain unlawful material.
Agree that BURTour may moderate, edit, or remove your content at our discretion.
10. Limitation of Liability
To the fullest extent permitted by law, BURTour LLC, its affiliates, and third-party providers shall not be liable for:
Any indirect, incidental, or consequential damages arising from your use of our services or participation in a tour.
Losses due to third-party provider failures, such as flight cancellations, hotel overbookings, or tour disruptions.
Injuries, damages, or losses incurred during travel, including those caused by natural disasters, political unrest, or other unforeseen events.
Our total liability for any claim arising from these Terms or our services shall not exceed the amount paid by you for the relevant booking.
11. Indemnification
You agree to indemnify and hold harmless BURTour LLC, its affiliates, and their respective officers, employees, and agents from any claims, losses, or damages arising from your breach of these Terms, violation of applicable laws, or misuse of our services.
12. Force Majeure
BURTour shall not be liable for any failure to perform our obligations due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, government actions, or technical failures.
13. Termination
We reserve the right to terminate or suspend your access to our services, with or without notice, if you violate these Terms, engage in fraudulent activity, or misuse our platform.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Cincinnati, Ohio, in accordance with the rules of the American Arbitration Association.
